Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Vynbe, an AI-powered iOS app builder operated by Youssef Bitar, a sole proprietor based in Morocco trading as “Vynbe” (“Vynbe,” “we,” “us”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Vynbe lets you describe an iOS app in natural language and uses AI to generate native SwiftUI source code, which is compiled on cloud macOS infrastructure. Depending on your plan, Vynbe delivers a simulator preview, a downloadable Xcode project, and — where you connect your own Apple Developer account — a signed build uploaded to your TestFlight for installation on your device. Publishing to the Apple App Store requires your own Apple Developer account and remains your responsibility.
2. Eligibility and accounts
You must be at least 13 years old (or the minimum age of digital consent where you live) and able to form a binding contract. You are responsible for activity under your account and for keeping your credentials secure.
3. Plans, fees, and refunds
Paid plans are billed in advance on a recurring basis through Polar, our Merchant of Record, who acts as the reseller of the Service and is responsible for collecting payment and any applicable sales tax or VAT. Plan limits (such as the number of builds) are described on our pricing page and enforced by the Service. You can cancel at any time; cancellation takes effect at the end of the current billing period and you retain access until then. Fees are non-refundable except where required by law.
4. Your content and ownership
You retain ownership of the app descriptions and content you submit and of the source code Vynbe generates for you. You grant us a limited licence to process, store, and transmit that content solely to operate the Service (including sending it to the AI and build sub-processors described in our Privacy Policy). We do not use your content to train AI models, and we claim no ownership of your apps.
5. AI-generated output
Generated code is produced by AI and provided “as is.” It may contain errors, may not compile, and may not be suitable for production without review. You are responsible for reviewing, testing, and complying with all obligations (including Apple’s App Store Review Guidelines) before publishing any app. Similar prompts may produce similar output for other users; we make no guarantee of uniqueness.
6. Acceptable use
You agree not to use the Service to generate or distribute apps or content that are unlawful, infringing, deceptive, malicious, or that violate Apple’s guidelines or any applicable third-party terms. You may not attempt to disrupt, reverse engineer, or exceed the intended usage of the Service, resell it without authorisation, use it to build competing AI models, or use it to harm others.
7. Third-party services
The Service relies on third parties including Clerk, Polar, Supabase, OpenRouter/Anthropic, Codemagic, Vercel, and Apple. Your use of the Service is also subject to their terms where applicable. We are not responsible for third-party services or outages outside our control.
8. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that any generated app will be accepted by the App Store.
9. Limitation of liability
To the maximum extent permitted by law, Youssef Bitar will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months preceding the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
10. Indemnification
You agree to indemnify and hold Youssef Bitar harmless from claims arising out of your content, your use of the Service, your apps, or your violation of these Terms or applicable law.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that risks harm to us or others. Sections that by their nature should survive termination (ownership, disclaimers, liability, indemnification, governing law) will survive.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with a new “Last updated” date and, where required, we will notify you.
13. Governing law & disputes
These Terms are governed by the laws of Morocco, without regard to conflict-of-law rules, and you agree to the exclusive jurisdiction of its courts, except where mandatory local consumer-protection law gives you the right to bring proceedings in your own country.
